The MacDonnells Law Insolvency Team is headed by Partner Cameron McKenzie and has members based in our Brisbane, Cairns and Townsville offices. The Insolvency Team overlaps with the MacDonnells Law Debt Recovery Team and is part of the MacDonnells Law Litigation Team, drawing on support from MacDonnells Law's Queensland-wide resources. Our insolvency lawyers work principally with liquidators, receivers, bankers, accountants, directors and creditors in areas where companies or individuals are insolvent or near insolvent. The MacDonnells Law Insolvency Team also has particular expertise in handling complex commercial transactions and relishes the challenge of large and complex insolvency matters.
Innovative solutions provided by the Queensland-wide MacDonnells Law Insolvency Team include:
- Acting for the receiver/liquidator of a mortgage run out business with property holdings across Queensland. The MacDonnells Law Insolvency Team devised the means for an appointment of a Special Liquidator to deal with select properties without interruption of the substantive administration.
- The MacDonnells Law insolvency lawyers devised the means by which some 100 investors in an unregistered Managed Investment Scheme could be given cost effective advice on their options for taking recovery action against a third party. Thisincluded the development of the means by which the investors' interests could be registered, instructions taken, advice given, the conduct of group meetings and the development of precedent documents to enable the litigation to be advanced effectively.
- Acting for the voluntary administrators of a group of property development companies. The MacDonnells Law Insolvency Team successfully negotiated a Deed of Company Arrangement that avoided the necessity for the Secured Creditor to make a separate appointment thus maximising returns.
